Welcome to https://strathmore.edu/vc-run/, the official website of the Strathmore University Annual Run (SAR). These Terms and Conditions (T&Cs) govern our website located at https://strathmore.edu/vc-run/ (Terms and conditions link), and any of SAR’s other registered domains, mobile apps, or social networking pages, profiles or feeds that post a link to these Terms (collectively, the “Services”).

Please read these T&Cs carefully before registering for the Strathmore University Annual Run. By registering, you accept these Terms and consent to our Privacy Policy that can be found here https://strathmore.edu/vc-run/ (privacy policy link) If you do not agree, please do not register for this event. SAR reserves the right to change the information, features, policies, promotions, disclosures, and disclaimers of the services at any time in our sole discretion without prior notice. Changes to these T&Cs will be posted on the services as they occur. All such changes are effective immediately when we post them, or such later date as may be specified in the notice of updated Terms and any applicable additional Terms.

By registering for this event, all participants agree to abide by these rules and regulations and comply with all reasonable directions and decisions made by the event officials and representatives of Athletics Kenya and World Athletics. Your agreement or consent will be legally binding and enforceable, and the legal equivalent of your handwritten signature
Any breach of these Terms and Conditions immediately terminates your rights with respect to our services.

Rules and regulations

1. Terms and Conditions – Entry

  • The official entry form must be completed fully by each intending participant. Completion of the entry form and payment of the entry fee represents acceptance of these terms and conditions.
  • Entry application will only be processed after receipt of full payment of the entry fee prescribed.
  • Participants must be capable of completing the race distance chosen at sign-up. It is their responsibility to undertake the necessary preparation and training required for their race distance. By entering our event, runners agree that on their chosen race day they will be fit and healthy enough to participate in the race unaided. If in doubt, please seek medical advice.
  • Participants take cognizance of the fact that running is a strenuous activity and will result in physical exhaustion. They enter the race at their own risk and shall discharge the organisers and sponsors for any injury, illness, loss, or equipment damage incurred as a result of their participation. On the event day, the participants will be responsible for their personal safety including but not limited to: the running route they choose to run on and its associated risks, their running times, hydration along the running routes.
  • Participants of 21km, and 10km must be over 18 years of age.
  • Participants under the age of 18 must always be accompanied by a responsible adult who has agreed to be bound by the terms and conditions of the event. It is the responsibility of the parent or guardian of the entrant to ensure that participants can complete the distance. The parents or guardians will take full responsibility and liability for the minors participating in the event.
  • There will be no fee refunded if the event is cancelled for whatever reason or if the participant does not take part in any of the races.

Conformity

It is the responsibility of the competitor to familiarise themselves with the event’s rules, the race formats, and any directions as published in the ‘Runners guide’, marathon website or communicated to them in any other form.

The Strathmore Annual Run respects your privacy and we are committed to keeping your personal information and other data confidential and secure.

1. When does this Data Privacy Statement apply?

This Data Privacy Statement explains the approach taken by the Strathmore University Annual Run and the members of STRATHMORE UNIVERSITY, (“we” or “us”) towards the personal information and data that we collect about you (“Your Information) when you:

  • Visit its websites
  • Register for the Strathmore Annual Run
  • Register for the Strathmore Annual Run by filling physical forms
  • Electronically respond to our online advertisements
  • Send us communications via any computer, mobile or other similar electronic devices (“Device”)

and information collected through the registration forms for purposes of the Strathmore Annual Run.

This Data Privacy Statement is limited to information and data collected as above. The Data Privacy Statement does not apply when you leave our Website, including third-party websites where our online advertisements are displayed or links to third party websites which we do not operate or control. Please read the privacy statement and terms and conditions of these third-party websites and decide whether they satisfactorily protect your rights.

3. What information do we collect about you?

  • Personal information, this is the information about an individual from which that person can be identified, is required for your registration to the Strathmore University Annual Run. We may collect, use, store and transfer different kinds of personal data about you. We have grouped together as follows:

    • “Identity Data” includes surname, first name, date of birth, images, race number, gender, nationality and emergency contact
    • “Contact Data” includes billing address, residential address, delivery address, email address, social media handles, emergency contact and telephone numbers
    • “Financial Data” includes bank account and payment card details
    • “Transaction Data” includes details about payments to and from
    • “Technical Data” includes internet protocol (IP) address, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform on the devices you use to access the our event site
    • “Profile Data” includes feedback and survey responses, performance, results and times at our events
    • “Usage Data” includes information about how you use the Site, products and services
    • “Marketing and Communications Data” includes your preferences in receiving marketing from Us and Our third parties and your communication preferences

    Additionally, the Website is designed to use Cookies to collect information about how people use the website (see Use of Cookies) and in some parts of our website, we specifically ask for Your information.

    Use of Cookies

    Physical registration forms and online forms personal information shall be submitted when you complete physical or online forms to register for the Strathmore University Annual Run or when you submit an enquiry online. Please ensure you also read any applicable Terms and Conditions for participating in the Strathmore Annual Run.

4. How we use your information

We will always treat your information as confidential. We will use good practices to keep it secure and will otherwise abide by the relevant data protection and privacy laws. The information collected shall only be used in relation to the Strathmore University Annual Run. Most commonly, we will use your personal data in the following circumstances:

  • Where we need to perform the contract we are about to enter into or have entered into with you upon registering for the event
  • Where it is necessary for the events’ legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests.
  • Where we need to comply with a legal or regulatory obligation.

5. Disclosing your information

When using your information for the purposes we may need to disclose it to more than one department within the Strathmore University and to our agents, advisors and third-party service providers (“other parties”). When this happens, we will require the other parties to handle your information using the same level of care that we apply. We will also require them to only use your information according to our instructions and directions.

If the other parties are overseas your information may be sent to another country including countries with weaker privacy and data protection laws than in your country of residence. We will not otherwise disclose your information to third parties unless we have your permission, or we are under a legal or similar obligation.

This means, by way of example that your information may be disclosed to:

  • Internal third parties supporting the execution of The Strathmore University Annual Run from time to time:
    • The administration of The Strathmore Annual Run (such as reporting obligations and preparation of the University’s accounts)
    • The promotion of the work of The Strathmore Annual Run.
    • Dealings with sponsors and suppliers of our events.
    • Dealings with participants in our events.
  • External third parties supporting the execution of The Strathmore Annual Run from time to time:
    • Agents, advisors or third-party service providers acting as processors, who provide various services such as event entry, entry management and supporting services, timing services, services with respect to the dissemination of photos, videos and other memorabilia, facilitation services for graphical representation of results, data analysis services, publication of race results services and IT and system administration services under a duty of confidentiality to the Strathmore University.
    • Regulators, supervisors, governments or quasi-governmental authorities in countries where we, our agents, advisors or third-party service providers have a presence
    • Anti-money laundering and fraud prevention agencies (where necessary for the purposes)
    • Third party athletic bodies and affiliations such as:
      1. World Marathon Majors LLC, to allow them to:
        • Validate anyone who is entitled to Six Star Finisher status (or equivalent) or where runners are on the journey to such achievement;
        • Operate the Abbott World Marathon majors age group world championships and rankings (See how it works );
        • World Athletics and Athletics Kenya, to allow them to populate the power of 10 ranking system.
      2. Broadcasters allow them to commentate on our events.
    • Where you have consented to pass your personal data to third parties (for example, hotel groups about accommodation in relation to our events or charities where you have initially been unsuccessful in your event application).
    • Media, where we deem that there is a human-interest story about your participation at one of our events.

6. Retaining your information

We will retain your information for as long as the purpose for which we collected it continues. It is then destroyed unless further retention is required to satisfy a legal, regulatory or accounting requirement or to protect our interests.

7. Privacy, security and communication using the internet

  1. The internet is not a secure form of communication and sending and receiving information over the Internet carries with it risks including the risk of access and interference by unauthorized third parties. It is your responsibility to maintain the secrecy of any user ID and login password you hold.
  2. Information passing over the Internet may be transmitted internationally (even when sender and recipient are located in the same country) via countries with weaker privacy and data protection laws than in your country of residence. As a result, we do not accept responsibility or liability for the confidentiality, security or integrity of Your Information in connection with its transmission over the Internet.
  3. In order to maintain the security of our systems, protect our staff, record transactions, and, in certain circumstances, to prevent and detect crimes or unauthorized activities, we reserve the right to monitor all Internet communications including web and email traffic into and out of our domains.

8. What are your personal data protection rights?

  1. We respect your personal data, and you have the following rights about how we use your information:

    • Your right to access your data – you have the right to check whether we hold personal data about you, and you can ask us for a copy of such data and information on how we have used it.
    • Your right to correct your data – if your personal details have changed, or you believe we have incorrect or out-of-date information about you, you can ask us to update.
    • Your right to delete your data – you can ask us to delete your personal data. However, we may need certain personal details to provide our products and services to you.
    • Your right to restrict or object to processing – you can ask us to stop using your data or change how we use it. However, we may need certain personal details to engage with you or provide our products and services to you.
    • Your right to object to automated decision making – you can ask us to review a decision made solely by automated processing if it negatively impacts you.
    • Your right to data portability – you can ask us to provide your personal data to another organisation in a format that can be easily read by machines.
    • Your right not to provide or change or withdraw consent – we may from time to time ask for your consent to process your personal data. You can choose not to provide such consent or let us know at any time if you change your mind about the consent already provided. However, we may not be able to provide our products and services or engage with you without certain personal data.
    • Your right to withdraw from direct marketing – you can withdraw your consent and tell us to stop sending you marketing emails or use your personal information for marketing purposes after the Strathmore University Annual Run.
    • Your right to be informed of the use to which your personal data is to be put – this privacy notice informs you of how your personal data will be used.

  • I have read the Rules and Regulations and the terms and conditions of Entry and Participation ( https://strathmore.edu/vc-run/ ) and agree to participate on the understanding that I will adhere to all the provisions stated therein for the event entered.
  • I understand the risk of participating including risks associated with the risk of dehydration and the risk of being on a course with vehicle traffic, even if the course may be regulated/ policed.
  • I understand that I must be of, and must train to, an appropriate level of fitness to participate in the event.
  • I am physically fit and capable of participating in the event and I have not been advised otherwise by a qualified medical practitioner.
  • I, for myself and my legal representatives, waive all claims of whatsoever nature against any and all sponsors of the event, Nairobi City County, all political entities, authorities and officials, all contractors and construction firms working on the event, all Strathmore Annual Run Local Organising Committee persons, officials and volunteers and all other persons and entities associated with the event and the directors, employees, agents and representatives of all or any of the aforementioned including, without limitation, any claims that light result from my participation in the event and whether on account of illness, injury, death or otherwise.
  • If I am injured or taken ill or otherwise suffer any detriment whatsoever, I hereby irrevocably authorize the event organizers and officials to transport me to a medical facility and/ or to administer emergency medical treatment and I waive all claims that might result from such transport and/or treatment or delay or deficiency therein. I shall repay or reimburse any of my medical and emergency expenses and I hereby authorize you to incur the same. I shall provide to race officials such medical data relating to me as they may request. I agree that nothing herein shall oblige the event officials or organizers or any other person to incur any expenses or to provide any transport or treatment.
  • I understand that by agreeing to these terms and conditions, I consent to the use of my personal data including contact information, images, videos, motion pictures, recordings or any other records of this event (“information”) for any legitimate purposes, including commercial advertising by means of film, television, radio, print media, internet, publicity material or any other media now or in the future, marketing of products offered by the Organizer and those offered by sponsors to the Strathmore Annual Run, publishing and storing of the race results, ranking individual participants and keep a historic log of this data all for the purpose of staging the event(s) and for archival and historic purposes. I understand that there may be a need to disclose the information to the Organizers affiliate companies, agents, advisors and third-party services (“Other Parties”). Information shall be released to the parties on condition that the other parties handle my information only subject to the organizer’s instructions.
  • The terms and conditions of Entry and Participation and the clauses of the indemnity apply to all members of a group on whose behalf I am signing.
  • If I have under my care or control children below 18 years of age participating in the event, then I shall ensure that they are accompanied at all times by a responsible adult and understand that the terms and conditions of Entry and Participation and the clauses of the indemnity apply to such children. The parents or guardians will take full responsibility and liability for the minors participating in the event.
  • I hereby declare that the date and information provided on the entry form is true and correct.
  • By electronically submitting this form, I agree and confirm that I accept all terms and conditions, and waiver policy.
